Common questions

Rubbish Clearance Questions

Do I have to use a licensed waste carrier to take away my rubbish?

If you hire a business to take away household waste, the law expects you to take all reasonable measures to make sure it is handed only to an authorised person. For a private business, that means a carrier with a valid upper tier registration, because anyone who regularly carries other people's waste for business or profit must be registered. A registration number starts with CBDU followed by numbers, and you can check it on the Environment Agency public register by number, business name or postcode, or by phoning 03708 506 506.

What happens if my rubbish is fly-tipped by someone I paid to take it away?

It is a criminal offence not to take all reasonable measures to make sure your household waste goes to an authorised person. If the waste is fly-tipped and traced back to you, you could be given a fixed penalty notice or prosecuted, which can lead to a fine and a criminal record. Whether to prosecute is up to the local authority, and you can show that you met your duty, which is much easier if you checked the carrier registration first.

Do I need to keep a receipt or any paperwork when my waste is taken away?

There is no legal requirement for householders to keep records, and not having them does not prove you failed in your duty. But records can quickly show that you met it if fly-tipped waste is ever investigated, so it is worth keeping a receipt with the business details, noting the carrier registration number and vehicle details, and perhaps photographing their registration. The wider paperwork, such as waste transfer notes, does not apply to householders dealing with household waste.

Is asbestos or other hazardous waste treated differently from ordinary rubbish?

Yes. Waste is generally hazardous if it can harm people or the environment. GOV.UK lists examples including asbestos, batteries, solvents, pesticides, car oil, fridges and chemicals such as brake fluid and printer toner. Asbestos in particular is handled under stricter rules, so ask any clearance company what it can and cannot take, and contact your local council or a specialist before moving anything you think may contain asbestos. Marriott Services cannot take asbestos, hazardous waste or large construction waste.
